Terms of Service

Better Deen provides a personalized wellness and reflection service that allows our members to track their personal journey, build habits, and view their progress over time ("Better Deen content") through our mobile application and website ("Better Deen ready devices").

The Better Deen service is provided to you by Better Deen. You have accepted these Terms of Service, which govern your use of our service. As used in these Terms of Service, "Better Deen service", "our service" or "the service" means the personalized service provided by Better Deen for tracking wellness, building habits, personal reflection, and accessing Better Deen content, including all features and functionalities, our mobile applications, websites, and user interfaces, as well as all content and software associated with our service. References to 'you' in these Terms of Service indicate the member who created the Better Deen account and whose payment method is charged.

1. Membership

1.1. Your Better Deen membership will continue and automatically renew until terminated. To use the Better Deen service you must have Internet access and a Better Deen ready device and provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time and which may include payment through your account with a third party (such as Apple App Store or Google Play Store). You must cancel your membership before it renews in order to avoid billing of the subscription fees for the next billing cycle to your Payment Method (see "Cancellation" below).

1.2. Some subscriptions are offered by third parties in conjunction with the provision of their own products and services (such as app stores). We are not responsible for the products and services provided by such third parties, and their own terms and conditions will apply to purchases made through their platforms.

2. Promotional Offers

We may from time to time offer special promotional offers (such as discounts, free trials, and other incentives), plans or memberships ("Offers"). Offer eligibility is determined by Better Deen at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Members of households with an existing or recent Better Deen membership may not be eligible for certain introductory Offers. We may use information such as device ID, method of payment or your contact information to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign-up for the Offer or in other communications made available to you.

3. Billing and Cancellation

3.1. Billing Cycle. The subscription fee for the Better Deen service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated in your account settings. The length of your billing cycle will depend on the type of subscription plan that you choose when you signed up for the service. Subscription fees are fully earned upon payment. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid subscription began on a day not contained in a given month. Visit your account settings to see your next payment date. If you signed up for Better Deen using your account with a third party as a Payment Method (such as through the Apple App Store or Google Play Store), you can find the billing information about your Better Deen subscription by visiting your account with the applicable third party.

3.2. Payment Methods. To use the Better Deen service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details.

3.3. Updating your Payment Methods. You can update your Payment Methods by going to your account settings. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

3.4. Cancellation. You can cancel your Better Deen membership at any time, and you will continue to have access to the Better Deen service through the end of your billing period. To cancel, go to your account settings within the app or on our website and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. In your account settings you can see when your account will close. If you signed up for Better Deen using your account with a third party as a Payment Method (such as the Apple App Store or Google Play Store) and wish to cancel your Better Deen membership, you may need to do so through that third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Better Deen service through that third party.

3.5. Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time. We will notify you at least 30 days before any price changes or changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect.

3.6. No Refunds. Payments are nonrefundable and there are no refunds or credits for partially used subscription periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period.

3.7. EU Consumer Rights. For users in the European Union, you statutorily have a 14-day right to cancel digital content purchases. By signing up for Better Deen and agreeing to these Terms of Service, and by beginning to use the service immediately upon purchase, you explicitly request immediate access to the digital content and acknowledge that you thereby waive your 14-day cancellation right. Once you begin using the service, your right of withdrawal ends.

4. Better Deen Service

4.1. You must be at least 13 years of age to become a member of the Better Deen service. Individuals under the age of 18 should utilize the service with the involvement, permission, and supervision of a parent or legal guardian, under such person's account and otherwise subject to these Terms of Service.

4.2. The Better Deen service and any content accessed through our service are for your personal and non-commercial use only. During your Better Deen membership, we grant you a limited, non-exclusive, non-transferable right to access the Better Deen service and Better Deen content through the service. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for commercial purposes or to share your account credentials with others.

4.3. The Better Deen service, including the Better Deen content and features, is regularly updated. We therefore do not guarantee that particular content or features will be available on the Better Deen service at any given time. In addition, we continually test various aspects of our service, including but not limited to our applications, user interfaces and features.

4.4. You agree to use the Better Deen service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. Except as explicitly authorized by us, you agree not to:

  • (i) archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the Better Deen service;
  • (ii) circumvent, remove, alter, deactivate, degrade, block, obscure or thwart any of the content protections or other elements of the Better Deen service, including the graphical user interface, copyright notices, and trademarks;
  • (iii) use any robot, spider, scraper or other automated means to access the Better Deen service;
  • (iv) decompile, reverse engineer or disassemble any software or other products or processes accessible through the Better Deen service;
  • (v) insert any code or product or manipulate the content of the Better Deen service in any way;
  • (vi) use any data mining, data gathering or extraction method;
  • (vii) upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Better Deen service, including any software viruses or any other computer code, files or programs;
  • (viii) engage in any of the foregoing in connection with the use, creation, development, modification, prompting, fine-tuning, training, testing, benchmarking or validation of any machine learning tool, model, system, algorithm, product or other technology; or
  • (ix) use the service in any manner that could harm, disparage, or negatively affect Better Deen, other users, or any third party.

We may terminate or restrict your use of our service if you violate these Terms of Service or are engaged in illegal or fraudulent use of the service.

4.5-4.6. Software and Device Compatibility

4.5. The Better Deen software is developed by, or for, Better Deen and may solely be used for authorized access to the Better Deen service through Better Deen ready devices. This software may vary by device and medium, and functionalities may also differ between devices. By using our service, you agree to receive, without further notice or prompting, updated versions of the Better Deen and related third-party software. If you do not accept the foregoing terms, do not use our service.

4.6. By using our service, you agree to look solely to the entity that manufactured and/or sold you the Better Deen ready device for any issues related to the device and its compatibility with the Better Deen service. We do not take responsibility or otherwise warrant the performance of Better Deen ready devices, including the continued compatibility with our service.

5. Account Access and Security

You are responsible for any activity that occurs through the Better Deen account. To help maintain control over the account and prevent any unauthorized users from accessing the account, you should maintain control over the devices that are used to access the service and not reveal the password or details of the Payment Method associated to the account to anyone. You agree to provide and maintain accurate information relating to your account, including valid contact information so we can send you account related notices. We can terminate your account or place your account on hold in order to protect you, Better Deen or our partners from identity theft or other fraudulent activity. Better Deen is not obligated to credit or discount a subscription for holds placed on the account by either a representative of Better Deen or by the automated processes of Better Deen. If your Better Deen ready device is sold, lost or stolen, please log out of your account or contact us. If you fail to log out or deactivate your device, subsequent users may access the Better Deen service through your account and may be able to access certain of your account information.

6. Wellness Disclaimer and No Professional Advice

6.1. Better Deen is a wellness and reflection tool designed to help you track your personal journey, build habits, and view your progress over time. Better Deen does not provide medical, psychological, mental health, religious, or other professional healthcare or counseling services. The service is meant to support your personal wellness journey, not to replace professional care.

6.2. The content, features, and tools provided through Better Deen (including any habit tracking, reflection prompts, or wellness-related content) are for general informational and personal use purposes only. They do not constitute professional advice of any kind.

6.3. Always seek the advice of a qualified healthcare provider, mental health professional, religious authority, or other appropriate professional with any questions you may have regarding your health, mental wellbeing, spiritual matters, or personal circumstances. Never disregard professional medical or mental health advice or delay in seeking it because of something you have read, seen, or tracked in Better Deen.

6.4. Better Deen is not a substitute for professional treatment, therapy, counseling, medical care, or religious guidance. If you are experiencing a medical emergency or mental health crisis, contact emergency services or a crisis helpline immediately.

6.5. You acknowledge and agree that you are solely responsible for how you use the information and tools provided by the Better Deen service, and that Better Deen assumes no responsibility for any decisions you make based on content accessed through the service.

7. User Content and Data

7.1. You retain ownership of any content you create, enter, or upload to Better Deen (such as journal entries, notes, goals, reflections, or check-ins) ("User Content").

7.2. By using the service, you grant Better Deen a limited, worldwide, non-exclusive license to use, store, process, and display your User Content solely as necessary to operate, maintain, improve, and provide the Better Deen service to you. This includes storing your data, backing it up, displaying it to you within the app, and using aggregated, anonymized data to improve our service.

8. Disclaimers of Warranties and Limitations on Liability

8.1. THE BETTER DEEN SERVICE AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE BETTER DEEN SERVICE, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. BETTER DEEN DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE BETTER DEEN SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS OR ACHIEVE ANY PARTICULAR RESULTS. BETTER DEEN SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF APPLICATIONS, BETTER DEEN READY DEVICES, AND BETTER DEEN SOFTWARE (INCLUDING THEIR CONTINUING COMPATIBILITY WITH OUR SERVICE).

8.2. TO THE FULLEST EXTENT PERMITTED BY LAW, BETTER DEEN DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8.3. TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL BETTER DEEN, OR ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

8.4. TO THE FULLEST EXTENT PERMITTED BY LAW, BETTER DEEN'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL BE LIMITED TO THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

8.5. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you, and you may have additional rights under local law.

8.6. NOTHING IN THESE TERMS OF SERVICE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.

9. Third-Party Services and Integrations

9.1. The Better Deen service may link to or integrate with third-party tools, services, and platforms (such as authentication providers, app stores, analytics services, advertising partners, or email services).

9.2. We do not control these third parties and are not responsible for their content, policies, privacy practices, or actions. Your use of third-party services may be governed by their own terms and privacy policies.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Better Deen and its owners, employees, partners, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the service; (b) your violation of these Terms of Service; (c) your violation of any rights of another party; or (d) your User Content. We will try to notify you of any such claim if we can do so reasonably.

11. Termination and Suspension

11.1. You may stop using the Better Deen service at any time and may request to delete your account as described in our Privacy Policy.

11.2. We may limit, suspend, or terminate your access to the Better Deen service if we reasonably believe:

  • (a) You have seriously or repeatedly violated these Terms of Service or applicable law;
  • (b) Your use poses a risk to us, the service, or other users;
  • (c) Continued provision of the service to you is no longer commercially viable; or
  • (d) We are required to do so by law.

11.3. Where reasonable and legally permitted, we will try to provide you with advance notice of any suspension or termination. However, we reserve the right to suspend or terminate access immediately if we believe there is an urgent need to do so. 11.4. Upon termination, your right to use the service will immediately cease. Even after your access ends, certain sections of these Terms (including but not limited to intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law) will continue to apply.

12. Feedback and Suggestions

Better Deen is free to use any comments, information, ideas, concepts, reviews, suggestions, or techniques or any other material contained in any communication you may send to us ("Feedback"), including responses to surveys, questionnaires, or through postings to the Better Deen service, worldwide and in perpetuity without further compensation, acknowledgement, or payment to you for any purpose whatsoever including, but not limited to, developing, improving, or marketing the Better Deen service. In addition, you agree not to enforce any "moral rights" in and to the Feedback, to the extent permitted by applicable law.

13. Changes to Terms of Service

13.1. Better Deen may, from time to time, change these Terms of Service. We will update the "Last Updated" date at the top of this document when we do.

13.2. If we make material changes, we may provide additional notice (such as within the app, by email, or on our website) where appropriate and as required by law.

13.3. For existing members, material changes shall, unless otherwise stated, be effective 30 days following notice to you. By continuing to use the service after changes take effect, you accept the updated Terms of Service.

13.4. We may assign our agreement with you to any affiliated company or to any entity that succeeds to all or substantially all of our business or assets related to the Better Deen service.

14. Events Beyond Our Reasonable Control

The Better Deen service and/or some features may not be available at any time as a result of events beyond our reasonable control, including but not limited to: (a) power or server outages; (b) acts or failures of any kind by third parties such as hosting providers or internet service providers; (c) natural disasters; (d) war, riots, strikes, or social unrest; and/or (e) any other events or factors beyond our reasonable control. While we will make reasonable efforts to maintain service availability and notify you when possible, we will not be held liable should such events occur.

15. Governing Law and Dispute Resolution

15.1. Governing Law. These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state where Better Deen is established or operates, without regard to conflict of laws provisions. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your state or country of residence.

15.2. Disputes. If you have a dispute with Better Deen, we encourage you to first contact us at info@betterdeen.com to seek an informal resolution.

15.3. Depending on your jurisdiction, you may have rights to pursue disputes through local consumer protection agencies, small claims court, or other legal mechanisms available under your local law. Nothing in these Terms is intended to limit rights that cannot be waived under applicable consumer protection laws.

16. Miscellaneous

16.1. Electronic Communications. We will send you information relating to your account (such as payment confirmations, subscription changes, notices, and updates) in electronic form only, for example via email or in-app notifications. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

16.2. Entire Agreement. These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Better Deen regarding your use of the service and supersede any prior agreements.

16.3. Severability. If any provision or provisions of these Terms of Service shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

16.4. No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

16.5. Customer Support. To find more information about our service and its features, or if you need assistance with your account, please contact us at info@betterdeen.com or visit the help section within the app. In the event of any conflict between these Terms of Service and information provided by Customer Support or other portions of our website or app, these Terms of Service will control.

16.6. Unsolicited Materials. Better Deen does not accept unsolicited materials, ideas, or suggestions for features or content. Should you send any unsolicited materials or ideas, you do so with the understanding that no additional consideration of any sort will be provided to you, and you are waiving any claim against Better Deen regarding the use of such materials and ideas.
